Terms of Service
The agreement between you and Svayam Incarnation Limited for using Intersink: your account, profiles, businesses and channels, paying, your rights as a consumer, what we may do if something goes wrong, and how either of us can end it.
1. Who we are and who these terms are for
Intersink is provided by Svayam Incarnation Limited, a company registered in England and Wales under number 15228262, with its registered office at 124 City Road, London, EC1V 2NX, England ("we", "us"). You can reach us at [email protected].
These terms apply to everyone who uses Intersink: people with a User ID, and businesses that create channels on Intersink. Some parts apply only to consumers, some only to businesses; each says so. If you use Intersink for a business, you confirm you are allowed to bind that business, and "you" includes it.
Other documents form part of this agreement and apply when you use the features they cover:
- Acceptable Use Policy and the Community rules: what is and isn’t allowed.
- Enforcement, suspension and termination: how decisions are taken and how to appeal.
- Business and Channel Terms: extra terms when you run a business or a channel.
- Fees, billing and refunds: how we charge and refund.
- Developer Terms and API Policy: if you use the Intersink API.
- Privacy Notice and Data Processing Addendum: how personal data is handled.
If these terms and another document conflict, the more specific document wins for its subject.
2. How Intersink is organised
Intersink is built from the same four things, repeated: a User ID (your account), the profiles you use in each place, businesses, and channels (a business’s website, shop, app or community). Every product on Intersink, including ours, is a channel.
An account or a business always belongs to the channel it was created on. That channel, and the channels above it, look after it: they may set their own rules, review businesses created there, and take decisions under the enforcement policy. We are responsible for Intersink as a whole and act as the top of every chain.
When you use a channel run by another business, that business is responsible for its own goods, services, content and terms, and for how it uses your data as a controller. We provide the platform it runs on.
3. Your User ID and profiles
You must be at least 16 years old to have a User ID. If you are under 18, a parent or guardian must agree to these terms on your behalf. Running a business, selling, taking payments and joining the developer program require you to be 18.
Give accurate information and keep it up to date. Keep your sign-in methods secure; you are responsible for what happens under your User ID unless it was caused by our failure. Tell us at once if you think someone else has accessed it.
A User ID is personal: don’t share it, sell it or transfer it. A business can give people access to itself through roles instead.
Your User ID exists per channel: the same e-mail can have separate accounts on different channels. Each account and each profile is its own item for safety decisions.
4. Businesses and channels
You can create businesses and channels from your User ID. When you do, the Business and Channel Terms also apply. A business may need to be verified (documents, identity, bank details) before it can sell, take payments or receive payouts.
A channel operator decides who may create an account on its channel (anyone, listed people, or nobody new) and may review businesses created on it. A channel of a business created on Intersink can enable its own API in its settings; no channel can pass API access to those below it (see the Developer Terms).
5. Paying for Intersink
Some parts of Intersink are free; others are paid (apps, storage, the developer program). Prices are shown before you agree to pay. Business plans are billed monthly in arrears on one invoice per business, with credits applied first; details are in Fees, billing and refunds.
If an invoice is not paid, we remind you, and after the reminder period the business’s billing is suspended: paid features stop until the invoice is paid. Your data is not deleted because of a late payment.
6. If you are a consumer
If you live in the UK, nothing in these terms affects your statutory rights, including under the Consumer Rights Act 2015. Digital content and services we provide must be as described, fit for purpose and of satisfactory quality, and services must be provided with reasonable care and skill.
You have 14 days from buying a paid service or subscription to cancel it and get a refund (Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013). If you ask us to start the service straight away, you pay for what you used before cancelling. Where the Digital Markets, Competition and Consumers Act 2024 subscription rules are in force, you also get reminders before renewals and an easy way to cancel online.
If you live in the EU, you have the equivalent rights under the law of your country, and you can always bring a claim in your local courts. If you live in the United States or elsewhere, you have the rights your local consumer law gives you that cannot be excluded.
When you buy from a business on Intersink, your contract is with that business, not us. Your rights against it (returns, refunds, faulty goods) apply as normal; we help where we can and may act under the enforcement policy if a business does not honour them.
7. Your content and licences
You keep ownership of what you upload or create. You give us a non-exclusive, worldwide, royalty-free licence to host, store, copy, adapt (for example resize or translate), display and distribute it, only as needed to run Intersink for you and the channels you publish on, and to keep Intersink safe. The licence ends when you delete the content, except for copies in backups (kept for up to 35 days), content others have shared under your settings, and anything the law requires us to keep.
You confirm you have the rights needed for what you upload and that it does not infringe anyone else’s rights. If someone believes it does, they can use our copyright and trademark process.
Intersink, its software, design and brand belong to us or our licensors. We give you a personal, non-exclusive, non-transferable licence to use Intersink under these terms; you may not copy, reverse engineer, resell or build a competing service from it, except where the law expressly allows.
8. What is not allowed
You must follow the Acceptable Use Policy and the Community rules, the law of the UK and of the places you operate in, and any channel rules that apply. In particular you must not use Intersink for anything illegal, harmful to children, fraudulent, abusive, or that infringes others’ rights; must not attack, overload, scrape or probe Intersink; and must not access Intersink by automated means except through the official API with an approved project.
9. Decisions about your account, profiles, businesses and channels
If something breaks these terms, the rules or the law, the channel responsible or we may warn, limit, suspend or end the item concerned. Each item is decided on its own: suspending a profile does not suspend your account; suspending your account does not stop you signing in, reading your notices or appealing.
Every decision comes with a statement of reasons: what was decided, why, the rule or law, whether it was found automatically or after a report, how long it lasts and how to appeal. You can appeal each decision once. The full process, including the notice periods we give businesses, is in Enforcement, suspension and termination.
10. Availability and changes to Intersink
We aim to keep Intersink available and publish incidents on our status page. We may need to suspend parts of it for maintenance, security or legal reasons; planned maintenance is announced ahead where we can.
We improve Intersink all the time. If we remove a paid feature you rely on, we tell you at least 30 days ahead (90 days for API changes that break existing integrations, see the Developer Terms) and refund any prepaid amount for the part you can no longer use.
11. Our responsibility to you
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited by law.
If you are a consumer: we are responsible for loss you suffer that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. We are not responsible for business losses, because Intersink for consumers is for private use.
If you are a business: we are not liable for indirect or consequential loss, loss of profit, revenue, goodwill or data (except our obligations to restore data from backups), and our total liability arising from or in connection with these terms in any 12-month period is limited to the greater of the fees you paid us in that period and £100. Except as set out in these terms, Intersink is provided "as is" to businesses, and implied terms are excluded to the extent the law allows.
A business agrees to compensate us for claims by third parties arising from its content, its products or services, or its breach of these terms or the law, except to the extent we caused them.
12. Ending the agreement
You can close your User ID, a profile, a business or a channel at any time from your settings. Closing a business ends its paid features at the end of the current billing period and produces a final invoice.
We may end the agreement with you, or close an item, as set out in the enforcement policy: with at least 30 days’ notice and reasons for a business (unless the law, a court or a serious risk requires immediate action), and after a statement of reasons in every case.
After closure you can download your data for at least 30 days, unless the law prevents it. We then delete or anonymise it according to the retention schedule. A channel is never deleted while it has an open legal obligation (for example unpaid invoices, open legal requests, or records we must keep).
Sections that by their nature should survive (licences for content already shared, payments owed, liability, law and disputes) survive the end of the agreement.
13. Changes to these terms
We may change these terms to reflect changes in the law, in Intersink, or in how we work. We tell you at least 15 days before a change takes effect (30 days for a change that is not to your benefit, or longer where the law requires), by e-mail or in the panel, and show what changed. A change needed to meet a legal or security obligation can take effect sooner.
If you do not agree to a change, you can close your account or business before it takes effect, without any charge for doing so. If you keep using Intersink after the change, the new terms apply.
14. Complaints and disputes
If you are unhappy, tell us first at [email protected] or through Help; we reply within 5 working days and try to resolve complaints within 30 days. Business users can also use our internal complaint-handling system described in the Business and Channel Terms, and may refer a dispute to mediation with CEDR (the Centre for Effective Dispute Resolution, cedr.com), as required by the UK Platform-to-Business Regulation.
Users in the EU may also refer a content moderation decision to a certified out-of-court dispute settlement body under the Digital Services Act.
These terms are governed by the law of England and Wales. Business disputes are subject to the exclusive jurisdiction of the courts of England and Wales. Consumers can bring proceedings in England and Wales or in the courts of the part of the UK or the country where they live, and keep the protection of the mandatory law of that country.
15. General
If a court finds part of these terms unenforceable, the rest stays in force. If we do not enforce a right straight away, we can still do so later. You may not transfer your rights under these terms without our agreement; we may transfer ours to a company that takes over Intersink, and will tell you if we do, without reducing your rights. Nobody else has rights under these terms under the Contracts (Rights of Third Parties) Act 1999, except channel operators where these terms say so.
We may need to suspend service to comply with sanctions and export-control laws of the UK, the EU, the United States and the United Nations. You confirm you are not a sanctioned person and will not use Intersink for a sanctioned party or in a sanctioned territory.
